Your Rights as a Member of the IAEP Local R7-11


Members of IAEP Local R7-11 have protections that are granted through their membership in the union. If called into
an interview with management that may result in disciplinary action, members have specific representational rights.
These are known as the Weingarten Rights.

Weingarten Rights

  1. You have the right to have a Union Steward or Union Representative present.
  2. If you want a steward present, YOU must ask for them.
  3. If you do not know why your manager wants to meet with you, ask them if it is a meeting that could result in
    a discipline.
  4. If your manager refuses to allow you to bring a steward, repeat your request in front of a witness. Do not
    refuse to attend the meeting, but do not answer any questions either. Take notes. Once the meeting is over, call
    your steward at once.
  5. You have the right to speak privately with your steward before the meeting and during the meeting.
  6. Your steward has the right to play an active role in the meeting. The steward is not just a witness.


The following Rules apply when an investigatory interview occurs


Rule 1:

You must make a clear request to have union representation present before or during the interview. You cannot be
disciplined for making this request.

Rule 2:

After a request for representation is made, management can do one of three things:
  1. Grant the request and delay questioning until your union representative arrives and has a chance to consult
    with you; or
  2. Deny the request and end the interview immediately; or
  3. Give you a choice of:
    1. having the interview without your union representative; or
    2. ending the interview

Rule 3:

If your manager or supervisor denies your request for union representation and continues to ask you questions, they are
committing an unfair labor practice and you have the right to refuse to answer. You cannot be disciplined for this refusal.


The following statement could save your job:

If this discussion could in any way lead to my being disciplined or terminated I respectfully request that my steward be
present at the meeting. Without representation present, I choose not to respond to any questions or statements.
