Fair Representation

The Duty of Fair Representation:

The union is obligated to represent fairly and diligently all employees of the bargaining unit.

Regardless of the Duty of Fair Representation, the union does not have to handle as a grievance every complaint that it receives from bargaining unit employees. As long as the decision to not process a complaint as a grievance is made in good faith and after investigating the circumstances, it does not violate the Duty of Fair Representation.

The Duty of Fair Representation applies only to situations that are within the control of the Union.
